AUTHORIZATION, TERMS, CONDITIONS & WARRANTY FOR SERVICE
Terms
Authorization for Repairs:
DPF Guys, LLC will provide the Customer with a verbal or written estimate before beginning any repairs. The Customer authorizes DPF Guys, LLC to perform the agreed-upon repairs and supply any necessary parts or materials. The scope of services will be discussed and approved by the Customer prior to commencing work. All work will follow the conditions outlined below.
Limited Warranty on Services:
DPF Guys, LLC warrants that services will be performed in a good and workmanlike manner for a period of 1 year from the service date. This warranty covers only the specific services provided by DPF Guys, LLC and does not include labor for removal or reinstallation of any parts on the vehicle. Warranty coverage is limited to correcting issues directly associated with the work performed by DPF Guys, LLC, such as cleaning or welding services, and does not extend to unrelated vehicle components. This warranty is void if damage is caused by issues such as upstream engine problems, including but not limited to fuel injector issues, turbo failure, misfire, low compression, exhaust leaks, coolant leaks, as well as DEF dosing issues, contaminated fuel, or damage due to accident or misuse.
This warranty is valid only if new clamps and gaskets were purchased at the time of service; DPF Guys, LLC will not warranty any parts where old clamps or gaskets were reused. Replacement parts, including but not limited to clamps or gaskets, required in any warranty service or re-cleaning may not be included in this warranty unless determined to be part of the failure covered by this warranty. Warranty claims require the vehicle or parts to be returned to a DPF Guys, LLC facility at Customer’s expense. This warranty is 100% transferable and will be subject to the same terms as here within.
Parts Warranties:
Parts warranties are limited to those provided by the applicable part manufacturer. DPF Guys, LLC disclaims all other warranties, including any implied warranties of merchantability or fitness for a particular purpose.
Payment Options:
Cash, Bank Check, EFS Check, COMCheck, ACH, Visa, Mastercard, Discover, Amex (All Credit Card Payments Will Have 4% Credit Card Fee Added)
Chargeback Waiver and Refund Policy:
By entering into this Agreement, the Customer acknowledges and agrees not to file a credit card chargeback under any circumstances. The Customer expressly waives all rights to initiate a chargeback for any payments made to DPF Guys, LLC. Refunds are only available under the terms of the Limited Warranty provided by DPF Guys, LLC or with explicit, written approval from DPF Guys, LLC. Any attempt to seek a refund or dispute a charge outside of these conditions will constitute a breach of this Agreement, and DPF Guys, LLC reserves the right to pursue any remedies available under the law.
NSF Fees and Fraudulent Payments:
Any checks or ACH payments returned for insufficient funds (NSF) will incur a minimum NSF fee of $35. The Customer agrees to reimburse DPF Guys, LLC for any NSF fees incurred as a result of insufficient funds. DPF Guys, LLC will prosecute fraudulent checks and ACH transactions to the fullest extent of the law.
Limitations of Liability:
DPF Guys, LLC is not liable for any delays due to part availability or for any loss or damage to Customer’s property resulting from fire, theft, or other causes. Under this Agreement, DPF Guys, LLC’s total liability is strictly limited to the original price paid for the service. This limitation excludes any indirect, incidental, or consequential damages, including, but not limited to, loss of income, loss of vehicle use, towing costs, or any other expenses.
Mechanic’s Lien, Payment Terms, and Abandoned Parts:
A mechanic’s lien on the vehicle secures all repair costs, including storage and towing. If payment is not received within 10 days after repair completion, DPF Guys, LLC may initiate lien sale proceedings or refer the account to collections. Customer agrees to cover collection fees and late charges as allowed by law. Any parts or materials left at DPF Guys, LLC’s facility for more than 30 days after notification of completion will be considered abandoned and become the property of DPF Guys, LLC.
Governing Law and Venue:
Georgia law governs this Agreement, and disputes are to be settled in the county where DPF Guys, LLC is located. Claims against DPF Guys, LLC must be filed within 90 days of service.
Sublet Repairs:
DPF Guys, LLC may subcontract portions of the work as deemed necessary.
Communication and Data Use:
Customer agrees that DPF Guys, LLC and its partners may use Customer data for service support, marketing, or sales, and may disclose anonymized data to third parties.
